- With the rise of various industries due to the development of science and technology, conflict of interests among stakeholders have become complicated. Concrete norms and policies have become necessary in order to solve these issues. In addition, with the development of technology, the ongoing economic globalization has brought the focus of attention to transnational protection measures on intellectual property rights.
This trend has brought about the harmonization of international norms, and new problems have been raised by the development of technology. Under the situation where the law has been revised repeatedly, Korea should actively participate in this trend.
Regarding the normative formation of genetic resources, discussion issues related to genetic resources were analyzed. In addition, countermeasure has been pursued based on the analysis of the necessity of a genetic resources disclosure requirement in patent application, the analysis of the genetic resource utilization systems and intellectual property rights systems of major countries, and the analysis of the legal validity of the introduction of disclosure requirement in patent application.
In the analysis of issues related to the formation of traditional knowledge norms, the issue of discussion on the traditional knowledge has been covered. Based on the analysis of the issues related to the classification and protection of traditional knowledge, policy countermeasures to be suggested in the discussion of international norms for the protection of traditional knowledge has been proposed.
과학기술의 발달로 다양한 산업들이 부상하게 되면서 이에 대한 이해관계가 복잡해지고 있으며, 각국은 이를 해결하기 위한 구체적인 규범 및 정책을 정립해나가고 있다. 또 한, 기술의 발전과 더불어 경제 글로벌화는 지식재산권에 대한 초국가적 보호조치에 대한 관심으로 표출되기 시작했다. 이러한 추세에 따른 국제규범의 동조화 현상이 나타나게 되었고, 기술의 발전으로 새로운 지식재산에 대한 보호문제가 제기되기 시작하였다. 이에 대응하기 위해 국가간 대응도 빨라지고 있으며, 우리나라도 이러한 흐름에 적절한 대처가 필요하게 되었다. 특히 유전자원 및 전통지식에 관한 규범형성과 관련해서는 유전자원의 출처공개와 특허법적 보호, 주요국의 유전자원 이용제도와 지식재산권제도, 유전자원의 출처공개 의무화, 전통지식이 분류와 보호범위 등 다양한 논의가 진행되고 있으며, 이에 대한 우리의 대응전략을 모색해 보았다.
