초록[abstracts]
[의사 등 의료관계 종사자가 의료행위의 과정에서 그 주의의무를 해태하여 환자에게 상해 또는 사망이라는 악결과를 유발한 경우, 환자는 의사 등에 대하여 금전적 손해배상책임에 해당하는 민사책임을 추궁할 수 있다. 우리나라의 현행 법제에 의할 때 환자가 의사 등에 대하여 의료과실에 대한 민사책임을 추궁하는 방식으로 당사자가 법원에 대하여 소송을 제기하여 이루어지는 판결에 의한 분쟁해결 외에도 다양한 소송을 대체하는 분쟁해결제도(ADR)가 존재한다. 이렇듯 의료과실에 대한 민사책임을 추궁하는 경로는 다양해졌지만, 해당 사건에서 의료과실이 무엇인지, 인과관계가 존재하는지에 관한 사항을 결정함에 있어서는 우리나라 법원을 통하여 발전하여 온 의료민사책임과 관련된 판례의 법리가 근간이 되고 있음을 부정할 수는 없다. 우리나라는 그동안 판례의 법리를 통하여 의료과실소송의 민사책임에서의 의료과실과 인과관계, 설명의무의 법리가 정착시켜 왔고, 그 과정에서 법원은 시대의 흐름과 외국의 논의들을 수용하여 우리나라의 현실에 맞게 의료과실소송의 다양한 법리들을 발전시켜왔다고 평가할 수 있다. 특히 판례는 의료과실과 인과관계에 있어 환자 측의 증명부담을 경감시키는 한편 이를 무리하게 확장하는 것을 경계하기도 하고 의사의 설명의무와 지도의무를 강조하는 반면 환자의 협력의무의 필요성을 지적하는 등 손해의 공평․타당한 분배에 많은 고민을 하여 왔다. 앞으로 법원이 판례의 법리를 통하여 의료과실소송의 민사책임에서의 전개할 수 있는 과제로는 팀의료와 관련한 책임분배의 문제, 감정(鑑定)과 관련된 문제, 의료행위에 있어서 인공지능의 활용의 문제 등을 들 수 있을 것이다.
Patients can seek civil liability in the form of monetary damages, if medical doctors and medical practitioners breach their duty of care during medical practice and cause injury or death to patients. For such cases where patients seek civil liability against medical doctors for medical practice, in addition to bringing a lawsuit at the appropriate court, there are many methods, such as ADR, that substitute a traditional lawsuit at the appropriate courts. Although means to seek civil liability for medical practice has diversified, determination of medial fault and causation provides the basis for medical malpractice cases seeking civil liability. In the meantime, the legal liability of medical malpractice, causal relation and explanation duty in the civil liability of the medical malpractice lawsuit have settled through the case laws. In the process, by adopting the trend of the era and foreign discussions, the Korean courts have developed jurisprudence of medical malpractice suit. In particular, the precedents lessen the burden of proof for medical practice and causation on the patient’s part but take caution on excess expansion. While emphasizing doctor"s duty of explanation and guidance, the need for patient"s duty of cooperation is pointed out for fairness and appropriateness of damage distribution. The following issues that the court can develop in the civil liability of medical malpractice litigation through the judicial jurisprudence of the case are problems of distribution of liability directed to team medical care, problems related to appraisal, problems of utilization of artificial intelligence.]
