초록[abstracts]
[현재의 의학수준에서 치유불가능한 질병을 앓고 있는 환자가 불가역적으로 진행 중인 임종과정에서 극심한 고통을 받고 있는 경우, 스스로 ‘존엄하고 평화롭게’ 죽기 위하여 자신의 생명을 단축시키는 의료적 조력을 받을 권리가 있는지의 문제가, 20세기 말부터 특히 21세기에 들어와, 전 세계적 관심사가 되고 있다. 여기에서 의사가 환자의 죽음에 조력해도 되는지, 즉 ‘의사조력자살(physician-assisted suicide, PAS)’이 법적으로 정당화될 수 있는지의 문제가 활발하게 논의되어 왔으며, 이미 여러 나라에서 합법화되기에 이르렀다. 이 논문에서는 의사조력자살을 합법화한 국가들의 법제화 경위와 그 과정에서 논쟁이 된 내용들을 살펴보았다. 우선, 미국에서 논의를 촉발시킨 법원의 판결들(특히 Glucksberg 사건의 제1심·제2심판결과 연방대법원판결 및 Quill 판결)과 각주의 입법동향을 살펴보았고, 특히 전 세계적으로 모범입법으로 활용되고 있는 오레곤주의 존엄사법과 그 운영실제에 대하여 살펴보았다. 다음으로는 스위스, 네덜란드, 벨기에, 룩셈부르크, 독일 등 유럽국가들, 마지막으로 캐나다, 콜롬비아, 호주 등 에서의 입법경위와 입법내용 및 주요판례(독일 연방행정재판소 판결, 캐나다 Carter 판결, 콜롬비아 헌법재판소 판결 등)를 소개하였다. 이 논문이 향후 한국에서도 본격적으로 논의될 것으로 예상되는 의사조력자살 문제의 지평을 대체적으로 점검하는데 기여할 수 있을 것으로 기대한다.,
Since last decades of the 20th century, especially from the beginning of the 21st century, it has been seriously discussed around the world whether competent, terminally ill patients, who suffer from unbearable pain, should have a right to get medical assist to end his/her life for a dignified and peaceful death. Accordingly, it has been controversial issue whether it should be legally permitted for the physicians to provide medical assistance in dying of their patients, that is, the ‘physician-assisted suicide(PAS)’ should be legalized. Some countries legalized PAS already, while in many other countries heated debate on this issue is underway. This article introduces the historical background and controversial issues concerning legalization of PAS. As for the United States, the relevant court’s decisions(Glucksberg case, Quill case), each state’s laws, and inter alia Oregon’s Death with Dignity Act, which became a nationwide and worldwide model for legalizing PAS, are overviewed. Next, the background and criteria of laws legalizing PAS in Switzerland, Netherlands, Belgium, Luxemburg, Germany, Canada, Colombia, and Australia as well as relevant decisions(i.e. recent case of the federal administrative court of Germany, Carter case in Canada, and the case of the constitutional court in Colombia) are examined. This work aims to understand the problems and issues discussed in other countries in advance of forthcoming debate on legalizing PAS in Korea.]
