초록[abstracts]
[우리나라는 2004년 생명윤리 및 안전에 관한 법률의 제정 이후로 인간 배아 연구를 원시선 형성 이전까지만 연구한다는 기본 원칙, 즉 “14일 규정”을 도입해왔다. 그런데 최근 들어 유전자 편집 기술을 적용한 인간 배아 연구와 연계된 광범위한 과학적 성과를 통하여 이 규정의 문제점을 지적하는 윤리적, 법적 논의가 활발하다. 유전자 편집 기술 자체의 진보 뿐 아니라 인간 배아의 체외 배양에 대한 연구, 동물 배아 및 인간 줄기세포의 혼합 연구와 관련된 유전자 편집 연구, 인간 오가노이드 연구는 기존의 “14일 규정”의 논리를 반박하는 근거를 제시한다. 이 논문은 “14일 규정”과 유전자 편집 기술이 응용되는 다양한 과학 분야의 발전을 고찰하고, 과학적 성과로 인하여 기존 규정에 제기되는 쟁점을 분석하며, 향후 해당 제도를 개선하기 위하여 고려해야 할 사항을 제안하는 것을 목적으로 한다.
The Bioethics and Safety Act have adopted the “14-day rule” which refers to the basic research principle to limit human embryo research before appearing primitive streak since 2004. However, current broader scientific achievements regarding human genome editing research have re-emerged active discussion for the “14-day rule.” In particular, research on self-organization of human embryo in vitro, genome editing research regarding the animal or chimeric embryo, human organoid research and human organoid research shows evidences that justifies to extend the “14-day rule.” This article explores recent ethical and legal issues between scientific application on genome editing technology and the “14-day rule” and suggests possible considerations to discuss the revision of the “14-day rule” in the Bioethics and Safety Act for further studies.]
