- 초록 (Abstract)
- Since the European Union started enacting the proposed EU General Data Protection Regulation (GDPR) as a personal data protection scheme, the issue on ‘Right to be forgotten’ included in the original proposed GDPR became one of most controversial issues through the world. Such trend has influenced on Korea too and many discussions has been ongoing. Meanwhile, the Court of Justice of the European Union (ECJ) made a landmark ruling related to Right to be forgotten in the case of Google Spain SL, Google Inc. v Agencia Espanola de Proteccion de Datos (AEPD), Mario Costeja Gonzalez. This judgment is highly likely to give big influence to Korea`s legal discussion as well as EU`s legislation. However, inaccurate or exaggerated introduction may cause misunderstanding easily, furthermore wrong policy or legislation. It is the reason why this paper has to be prepared. This paper pursues objectives to introduce exact fact and meaning of the judgment, analyze personal data protection laws of EU and Korea comparatively and suggest implications from ECJ judgment and EU legislation. After comparative analysis of ECJ judgment and EU laws, this made two suggestions as followings. First, Right to be forgotten, regardless of what title of the right is, is not an absolute right, but the right to be adjusted to the reasonable extent. Korean Personal Data Protection Act provides no threshold requirement to claim the right to erasure corresponding Right to be forgotten. But this must be modified for establishing proper requirement. Second, it is necessary to establish process or legal basis or standard to balance against other fundamental rights, such as freedom of expression and of the media. However, this paper and suggested implications from EU case are just a starting point. To build a reasonable personal data protection law scheme, more concrete study and discussion must be needed.
