블록체인 의료의 법적 문제 = Legal Issues of Blockchain in Healthcare.

다국어 초록[Multilingual Abstract]
Heretofore medical data is stored only within a specific hospital due to legal and technical limitations, and is not easily provided to other hospitals or medical service providers or patients, even though it is obtained from patients. With the introduction of Electronic Medical Record (EMR), patients became more difficult to control their medical data as the system of medical data became electronic. However, with the advances of block-chain technology, it is anticipated that the medical data stored in each medical institution and the public institution can be managed in an integrated manner, so that it allows for patients to control their medical data. Furthermore these technologies enable the medical data to share between relevant organizations and can be actively used in a various medical industries such as insurance payments, pharmaceuticals and medical device distribution networks and even health care services. In addition, the introduction of block-chain technology into the healthcare industry is expected to save considerable cost in the entire medical industry, so that it will be possible to provide safe and affordable medical services in the future. Major countries are already working to encourage the digital healthcare industry by enacting the regulation to present standards in the health care industry. As the above paper, I want to prospect the future of healthcare industries by searching the possibility of using a block chain in the medical industry and focusing on the two major legal issues of block chain health care: protection of medical data and interoperability.
국문 초록[abstracts]
종래 의료데이터는 환자로부터 생성된 데이터임에도 불구하고 법적·기술적인 한계로 인하여 특정 병원 내에서만 보관되며 다른 병원 및 의료관련 서비스제공자에게는 물론 환자에게조차 원활하게 제공되지 않았다. 전자의무기록(Electronic Medical Record, EMR)제도 도입에 따른 의료데이터의 전자화로 인하여 환자는 자신의 의료데이터를 통제하기가 더욱 힘들게 되었다. 그러나 블록체인 기술의 등장으로 각 의료기관과 공공기관이 보관하고 있는 의료데이터를 통합적으로 관리할 수 있을 것으로 기대되면서 환자로 하여금 의무기록통제권을 향유할 수 있게 할 뿐만 아니라, 유관기관 간 전자의무기록을 공유하고, 보험금 지급, 의약품 및 의료기기 유통망 구축, 더 나아가 건강관리서비스 등 각종 의료산업분야에서의 선제적인 활용을 전망할 수 있게 되었다. 또한 보건의료산업에 블록체인기술이 도입될 경우 의료산업의 전반에서 상당한 비용을 절감할 수 있을 것으로 예견되고 있으며 향후 좀 더 안전하고 저렴한 의료의 제공이 가능할 것으로 기대되는 바, 의료산업분야의 블록체인 기술 도입은 반드시 고려되어야 할 것이다. 해외 주요국에서는 이미 앞 다투어 관련 규정을 제정하여 헬스케어산업분야에서의 기준을 제시하는 동시에 규제를 완화함으로써 디지털 헬스케어산업을 육성하기 위하여 적극적인 노력을 펼치고 있다. 이에 본고에서는 의료산업에 있어서 블록체인의 활용가능성을 살펴보고 블록체인의료에 있어서 두 가지 큰 법적 쟁점인 의료데이터의 보호와 상호운용성(interoperability)을 중점적으로 검토하면서 보건의료의 미래를 전망하고자 한다.
