의료정보 프로그램에서의 방송 허용범위에 관한 법적 고찰

국문 초록[abstracts]
현재 의료법은 방송을 통한 의료광고를 금지하고 있으며, 법으로 허용된 의료광고의 경우에도 ‘치료효과를 보장하는 등 소비자를 현혹할 우려가 있는 광고’, ‘환자의 안전에 심각한 위해(危害)를 끼칠 우려가 있는 부작용 등 중요 정보를 누락한 광고’, ‘방송 등을 이용하여 기사(記事) 또는 전문가의 의견 형태로 표현되는 광고’, ‘의료기관ㆍ의료인의 기능 또는 진료 방법에 관하여 객관적으로 인정되지 아니한 내용이나 객관적인 근거가 없는 내용의 광고’, ‘특정 의료기관ㆍ의료인의 기능 또는 진료 방법에 관한 기사나 전문가의 의견을 방송하면서 특정 의료기관ㆍ의료인의 연락처나 약도 등의 정보도 함께 방송하여 광고하는 행위’ 등은 금지된다. 이와 같이 의료기관의 방송광고를 엄격히 금지하고 있는 상황에서 의료정보 프로그램 출연을 통한 우회적 광고유인이 높을 수밖에 없고, 이는 낮은 수준의 의료정보 프로그램을 양산시키고, 방송의 상업적 활용 행태를 부추기는 결과를 초래할 수 있다. 하지만 일부 매체에서는 ‘의료광고’에서도 금지하고 있는 내용을 프로그램의 형태로 시청자에게 전달하고 있어, 위원회를 비롯하여, 각종 언론매체 및 관련 기관(국회, 식약처, 대한의사협회, 각종 시민단체 등)으로부터 이러한 문제점이 지속적으로 제기되고 있다. 이와 관련 본고에서는 최근 방송심의에서는 많은 문제점들이 반복적으로 지적되고 있어, 향후 방송 제작 및 편성시 개선이 필요하다는 점을 법적 검토를 통하여 지적하였다.
다국어 초록[Multilingual Abstract]
Currently, medical law prohibits medical advertising through broadcasting. In the case of medical advertising permitted by law, ‘advertising with a fear of misleading consumers, such as ensuring therapeutic effects,’ ‘Ads that are missing important information such as side effects that may cause serious harm to the safety of patients,’ ‘an advertisement expressed in the form of an article or an expert using a broadcast or the like,’ ‘advertising with content that is not objectively recognized as to the function or treatment method of a medical institution or healthcare provider,’ ‘broadcasting and advertising of information such as contacts and directions of specific medical institutions or medical personnel while broadcasting articles or expert opinions on the functions or treatment methods of specific medical institutions or medical professionals’ is prohibited. In this way, in the situation where the broadcasting advertisement of the medical institution is strictly forbidden, the attraction of the indirect advertisement through the appearance of the medical information program is inevitably high, this may lead to mass production of low-level medical information programs and to promoting the commercial utilization behavior of broadcasts. However, in some media, the contents that are forbidden in ‘medical advertising’ are transmitted to viewers in the form of programs, and it is necessary for the media to receive information from various media and these problems are constantly being raised by relevant organizations (such as National Assembly, KFDA, Korea Medical Association, various NGOs). In this regard, I have pointed out through the legal review that many problems have been pointed out repeatedly in recent broadcasting review, and it is necessary to improve broadcasting production and organization in the future.
