초록[abstracts]
한․중 FTA가 체결됨에 따라 한․중 양국은 국가 간의 자유무역협정과 관련된 상품뿐만 아니라 의료분야와 서비스분야까지 교역이 늘어나고 있는 중이다.
본 논문은 한․중 FTA 체결에 따른 의료분야의 의료사고 및 의료분쟁 해소를 위한 방법으로 양국간의 불법행위법 상 법률제도를 고찰하였다.
중국의 경제가 급속하게 발전하고 아울러 의료분쟁 건수도 증가 함으로써 이러한 사회 문제를 해결하기 위해 「의료 사고 처리방법」을 시작으로 2009년 불법행위법으로 발전하였다.
그동안의 민법통칙과 의료사고처리조례 즉 법률과 행정법규의 이원화 적용으로 인하여 법률적용 상의 문제를 안고 있었던 것이 사실이었다.
하지만 「불법행위법」의 제정으로 인하여 이러한 문제를 해결함은 물론 의료손해책임에 대한 전문 법률의 제정으로 의료분쟁에 있어서 해결 할 수 있는 토대를 마련하였다 볼 수 있다.
이러한 상황에서 본 연구는 의료제품손해책임,의료기술손해책임,
의료윤리손해책임, 의료제품손해책임으로 나누어 현황과 발전 방안을 제시 하는 것을 주요 목표로 하고 있다
.
본 논문을 서술함에 있어서 한국과 어떠한 차이점이 있는지 조사해보고, 특히 한. 중간의 용어의 차이점에서 비롯할 수 있는 분쟁에 대해서도 분석하였다. 아울러 의료분쟁해결에 있어 어떠한 문제점이 있는지 아울러 검토하였다.
중국의 불법행위법에 대한 인식과 기존 학술 논문과 정부발간 정책자료 등을 참조하여 분석하여 제시함으로써 현재 중국이 가지고 있는 의료손해책임에 대한 문제점을 분석하였다.
이를 토대로 한. 중간의 의료분야산업 발전을 위한 한․중간의 정책상의 제안 점을 제시 하였다.
초록[abstracts]
According to Korea and China FTA contract, both countries increase exponentially trade related products, moreover, medical industry and service industry.
This thesis considered legal system between both countries of Tort Law to solve problem with Medical accident and Medical dispute by Korea and China FTA agreement.
As the economy of China rapidly developed and the number of medical disputes has increased, it has developed into the illegal act law in 2009, starting with "medical accident handling method" to solve social problems.
It was a fact that there were problems in the application of the law due to the general rule of the civil law and the medical accident handling ordinance, that is to say, the dualisation of laws and administrative regulations.
However, due to the enactment of the "Tort Law", it is possible to solve these problems and to lay the foundations for resolving medical disputes by establishing specialized laws on medical liability damage.
Under this circumstance, this study conducted to investigate the medical product damage liability, medical technology damage liability,
medical ethical injury liability, and medical product damage liability.
In analyzing this paper, it is necessary to analyze the differences between Korea and China, examined closely the disputes that could arise from the differences in the intermediate terms.
In addition, we reviewed the problems of medical dispute resolution.
This paper analyzes the problems of China 's liability for medical damages by analyzing and presenting the perceptions of illegal laws in China and existing an academic essays and government publication policy data.
Based on this, it is proposed a policy of proposal point for the development between Korea and China medical industry.
