초록[abstracts]
[첨단과학기술사회에 있어 사회, 경제, 정치, 의료, 교육 등 다양한 분야에 있어 당사자들 간의 갈등과 분쟁은 그 형태와 양상이 매우 다양하게 나타나고 있다. 따라서 종래 법원을 통한 재판, 소송과 같은 갈등해결 방식으로는 헌법상 보장된 기본권을 충분히 보호할 수 없음이 드러나고 있다. 이러한 전통적인 갈등해결 방식이 가지는 문제점에 대한 대체적 방안으로 재판 외 분쟁해결절차(Alternative Dispute Resolution, 이하 ‘ADR’이라 한다)가 주목을 받고 있다. 재판외 분쟁해결절차는 법원을 통한 소송제도에 비하여 시간이 적게 걸리며 비용이 상대적으로 저렴하고 누구나 쉽게 접근할 수 있다는 장점이 있고 효율적인 분쟁해결 수단이다. 재판 외 분쟁해결제도의 헌법상 재판청구권 침해나 분쟁조정제도의 실효성 등에 관한 논의가 존재하나, 기본권의 효율적 보호를 위하여 다양한 권리보호수단을 마련하는 것은 법치주의 원리상 타당하다. 재판 외 분쟁해결절차의 종류 중 하나인 분쟁 조정제도의 필요성도 높아지고 있다. 본 논문에서는 재판 외 분쟁해결절차의의의 및 유형을 분석하고 그 중에서도 특히 개인정보분쟁조정제도에 대한 현황과 문제점 및 법제정비 방안을 고찰하여 당사자의 권리침해에 대한 신속하고 효과적인 해결을 도모할 수 있는 해결방안을 제시하고자 한다.
In the advanced scientific technology society, the forms and patterns of the conflicts and disputes between the involved parties have been diversely appearing in diverse fields such as society, economy, politics, medicine and education. Accordingly, it is being revealed that the basic human rights guaranteed by the constitution cannot be sufficiently protected through the preexisting traditional conflict resolution means such as trial and lawsuit executed through the court. ADR has been attracting the interest as an alternative to the traditional conflict resolution means. ADR provides more efficient dispute resolution means through not only requiring relatively less time and cost in comparison to lawsuits executed through the court, but also providing right protection means that anyone can easily have access to. Although there are discussions on whether or not ADR violates the right to trial guaranteed by the constitution and whether or not the dispute mediation system is effective, it is valid in terms of the principles of constitutionalism to establish diverse right protection means to efficiently protect the basic human rights, and the need for dispute mediation system serving as the new type of right protection means has been increasing. In this thesis, dispute resolution procedures other than the trial will be examined through classifying and analyzing types of dispute resolution procedures other than the trials that can be executed in accordance to the current law. Specifically, not only the status of and problems with the personal information dispute mediation system will be examined, but also the plans for consolidating the legislative system will be examined to propose a resolution plan that can be used to promptly and effectively resolve violation of rights among the involved parties.]
