초록[abstracts]
[본 논문의 목적은 동물 실험과 관련된 근본적인 물음인 윤리적인 동물 실험 자체가 철학적, 윤리적으로 정당화될 수 있는가를 규명하는 것이다. 이런 목적을 위해 필자는 동물 실험과 관련된 대표적인 이론인 동물권 이론과 공리주의적 관점에 입각한 동물복지론을, 동물 윤리에서 중요한 논변으로 간주되는 가장자리 상황 논변과 종차별주의 논변을 가지고 비판적으로 검토한다. 동물복지론에서는 공리의 원리에 입각해서 동물 실험뿐만 아니라 가장자리 인간 실험도 허용할 수 있으며, 동물권 이론은 동물 실험을 반대하는 입장과 허용하는 입장 모두가 가능하다. 이러한 도덕이론들 가운데 어떤 이론이 정당성과 현실성 모두를 확보할 수 있는지를, 실천윤리학에서 중요한 방법론으로 간주되는 롤즈의 광의의 반성적 평형론을 통해 검토했을 때, 필자는 인간 실험은 거부하면서도 동물 실험은 제한적으로 허용하는 수정된 동물권 이론이 정합적으로 정당화될 수 있다고 주장한다. 이 도덕이론에서는 동물권과 인간의 권리 사이의 우열이 인정되기 때문에 인간의 권리를 보장하기 위해서, 다른 대체 가능성이 없으며, 동물 실험의 필요성이 확실할 때에만 동물 실험이 제한적으로 허용된다. 이러한 동물권 이론은 동물 실험의 효과와 관련된 분명한 배경이론이 등장하거나, 숙고된 도덕판단이 수정되는 등의 새로운 환경에서는 광범위하게 수정될 수 있지만, 현 단계에서는 안정성을 가질 것으로 예상된다.,
Today, people ask whether animal experimentation can be practiced ethically, but they do not ask whether this search for ethical animal experimentation methods is philosophically justifiable. The question of justification is a more fundamental and important point because without answering this, the former question is only a house built on quicksand. The purpose of this paper is to examine this fundamental question. First, I examine which position individuals leading animal ethics discussions (primarily animal welfarism and animal rights advocates) take on animal experimentation. Then, I examine whether their positions, as moral principles, are feasible and justifiable. I do this by examining John Rawls`s method of wide reflective equilibrium, which is an attempt to guarantee justification by producing coherence in an ordered three sets of beliefs: considered moral judgments, moral principles, and relevant background theories. This method is dynamic and progressive because a moral principle reaching a wide reflective equilibrium can also be revised or moderated through a new wide reflective equilibrium if new evidence or a new background theory surfaces. Through this method, I argue that animal experimentation is permissible only when it is necessary for protecting human rights and there is no substitute.]
