초록[abstracts]
[자율성이란 개인의 선택을 방해하는 다른 사람의 통제나 제한으로부터 자유로운 자기규제를 의미하기 때문에, 의료행위에서 자율성 존중은 개인의 권리를 보장하기 위해 필수적인 요소이다. 그러나 개인으로 인해 대중의 위험과 해가 예상된다면 개인의 권리는 제한될 수 있다. 이종이식 임상적용에서는 인수공통감염병의 발생 가능성으로 인해 연구대상자 및 이종이식 수여자에게 평생추적, 동의 철회 제한, 사후 부검, 조직 기증, 격리 등이 필수적으로 부과되며, 이러한 조치들은 개인의 자율성과 권리를 침해하는 요인들이다. 이와 같이 공중보건을 위해 개인의 권리가 제한되는 것은 공익 추구와 사회정의로써 정당화되고 있지만, 여전히 이에 대한 합의와 근거는 부족한 것으로 보인다. 이에 본 논문에서는 공중보건에서 개인의 권리가 침해되는 것의 정당화 근거로 사전예방의 원리, 충분한 정보에 의한 동의, 관계적 자율성을 제시하였다. 결론적으로 공중보건을 위한 개인 권리의 제한은 개인의 이익과 공동체의 이익 사이의 긴장 그리고 개인의 자유와 공공의 안전 사이의 균형에서 그 합의점을 찾아야 할 것이다. 생명과학기술의 발전과 신종 전염병의 전파 가능성으로 인한 공중보건의 위협은 공중보건에 관한 새로운 윤리적 고찰을 더욱 요구한다.,
Respecting autonomy is an essential element in medical practice because it means free self-regulation that begins with limiting and controlling those who interfere with other individuals’ autonomous personal choices. However if there is a risk of danger to the general public as a result of an individual, then this individual’s personal rights may be restricted. During xenotransplantation clinical applications, in the case of an outbreak of zoonotic diseases, it may be necessary to impose life-long surveillance, a waiver of right to withdraw, a post mortem, tissue donation, and isolation on human subjects. These types of measures are factors that violate the individual’s autonomy. Therefore, the restriction of individual rights for public health is becoming a justification for social justice and the pursuit of the public interest. However, the basis of a mutual agreement on this issue is still lacking. This thesis researches the infringement of human rights as well as the precautionary principle, informed consent, and relational autonomy in public health. In conclusion, the restriction of individual rights for public health needs to find a middle ground that balances the tension between an individual’s freedom and the community’s safety. The progress of life science technologies and the occurrence of new infectious diseases will cause an increasing need for ethical considerations related to public health.]
