초록[abstracts]
[우리 사회는 오랜 시간 동안 모든 여성의 임신･출산을 사회적 당위이자 책무로 부여해 왔다. 이와 같은 태도는 여성의 사회적 지위와 존재를 생식 기능에 따라 규정하고 여성의 삶의 목적 역시 임신･출산으로 정당화함으로써 여러 가지 불평등을 야기했다. 여성의 임신･출산권 중 하나인 임신중단권의 보장은 임신･출산의 주체이면서도 배제되어 오던 임신중단에서의 여성의 자율성 회복을 의미한다. 또한 기존 낙태 용어가 가지던 부정적 측면과 한계를 극복하며 임신･출산 주체로 여성의 권리적 측면을 부각한다. ｢유엔여성차별철폐협약｣(CEDAW) 제8차 국가 이행보고서에 대하여 위원회는 임신중단 관련 보건 입법과 정책 검토의 필요성, 재생산건강 및 권리 관점에서 여성의 실질적 성평등 촉진을 권고하였다. 이를 위하여 ｢형법｣ 제269조제1항 등 이하 낙태의 죄에 대한 다음과 같은 대대적인 제･개정이 필요하다. 먼저 국가 차원의 정확한 임신중단 현황 파악을 위한 절차와 규제 정비 및 의료보험 내 편입이다. 다음으로 임부의 임신중단을 비범죄화하고 임신 기간에 따른 합리적 규제와 예외적 허용사유의 현실화 및 사회･경제적 사유의 신설이 필요하다. 또한 절차내 불필요한 배우자 동의 규정의 삭제, 전문의료인 책임 강화 명시 및 신설 등 여성의 건강권 보장을 위한 관련 법률의 제･개정 및 신설이 필요하다. 전 세계 국가들이 다양한 임신중단 입법정책을 가지지만 궁극적으로 모든 정책의 귀결이 임신중단의 감소를 목표로 한다는 것은 동일하다. 임신중단 문제 해결을 위해서는 무엇보다 사회적 합의와 수용을 통해 궁극적으로 여성의 임신중단 비범죄화를 지향해야 하며, 보다 명확하고 합리적인 임신중단 절차와 지원 보장을 통한 여성 건강권 보장 노력이 필요하다. 임신 중단권의 보장은, 임신･출산에 대한 여성의 자기결정권 보장이며 궁극적인 성평등 실현을 가능하게 한다.
For a long time, our society has imposed pregnancy and childbirth as social justice and responsibility on all women. Such attitudes have caused various inequalities by regulating the social status and existence of women according to reproductive functions and justifying women's purpose of life as a mere vessel for pregnancy and childbirth. The security of the right to termination of pregnancy which is one of the rights of pregnancy and childbirth of women, means the restoration of autonomy of women in the termination of pregnancy which is the subject of pregnancy and childbirth but has been excluded. It also overcomes the negative aspects and limitations of existing terms for abortion and emphasizes women's rights as pregnant and maternity subjects. On the 8th CEDAW National Implementation Report, the Commission recommended the promotion of substantial gender equality for women in terms of necessity of health legislation and policy review and the reproductive health related to termination of pregnancy. To this end, the following large-scale amendments to the criminalization of abortion such as Article 269, Paragraph 1 of the Criminal Code are required. First action to be taken is the regulatory maintenance and the inclusion of medical insurance for the process of identifying the current state of abortion at the national level. Then it is necessary to decriminalize the pregnancy termination of pregnant women and make rational regulation according to pregnancy period and to establish social and economic reason and exceptional allowable cause. In addition, it is necessary to revise and amend the related laws to guarantee the right of women, such as the removal of unnecessary spousal consent regulations in the procedure, the strengthening of the responsibility for professional medical care, and the establishment of new regulations.]
