초록[abstracts]
[현행 개인정보보호법제는 빅데이터 시대의 등장을 예상하고 만들어진 것이 아니다. 불명확한 비식별화, 옵트인 원칙 등은 빅데이터의 활용을 어렵게 하고 있다. 가장 민감한 정보 중 하나인 보건의료정보로 구성되는 보건의료 빅데이터에 대한 시민사회의 우려와 반대도 어찌 보면 당연한 일이다. 영국의 Care.data 사건이나 대만의 전민건강보험 사건, 우리나라의 약학정보원 사건 그리고 보건의료 빅데이터 플랫폼 사건까지 국내외를 막론하고 보건의료 빅데이터를 둘러싼 시민사회의 반발이 동시다발적으로 발생하고 있다. 이런 상황에서 시민사회의 적극적인 참여에 기반한 법제 개선 논의를 시작한 EU의 움직임은 주목할 만하다. 우리도 빅데이터의 주인인 시민사회의 참여로부터 법제 개선 방향을 도출해야 한다. 핵심 용어의 명확한 정의, 정보주체의 개인정보 통제권한 강화, 빅데이터 활용의 투명성 강화, 기술의 부정적 영향 최소화, 시민사회의 참여를 보장하는 상향식 거버넌스 등이 필요할 것이다. 법적 기반이 완비되고 이에 대한 시민사회의 신뢰까지 확보된다면, 고품질의 보건의료 빅데이터가 지속적으로 보건의료의 질을 향상시키는 선순환구조가 조성될 수 있을 것이다.
The current personal information protection laws did not foresee the emergence of the big data age when they were legislated. Problems of unclear de-identification, opt-in principle, etc. are making the utilization of big data difficult. The concerns and unease of the general public about healthcare big data consisting of healthcare information, one of the most sensitive kinds of information, are hardly unreasonable. The Care.data incident of the UK, the NHI (National Health Insurance) case of Taiwan, and the KPIC (Korea Pharmaceutical Information Center) case and the healthcare big data platform incident of Korea suggest that the opposition of civil societies to healthcare big data is simultaneously occurring across the world. In this situation, the move of the EU, which has started to discuss the improvement of related laws based on active public participation, is noteworthy. Korea, too, should also explore the desirable direction of legal improvement through the participation of the general public as the owners of healthcare big data. We will need clear definition of keywords, strengthening of rights of the subjects in control of personal information, strengthening of transparency in the utilization of big data, minimization of negative impacts of technologies, and bottom-up governance to ensure the participation of civil society. If the legal grounds are completed, and trust of civil society in the laws is secured, a desirable cycle wherein high-quality healthcare big data steadily improves the quality of healthcare can be established.]
