초록[abstracts]
[고령화 사회와 4차 산업혁명 시대를 맞아 인류 사회는 다른 사회구성원에게 의존적인 존재의 비율이 높아지는 상태를 맞닥뜨리게 될 것이다. 기존의 계약론적 접근은 사회협력과 기여의 능력이 있는 온전한 존재를 중심으로 정의문제를 논한다고 여겨져 왔다. 최근 이에 대한 도전으로서 누스바움의 역량접근법과 키테이의 돌봄 윤리가 제시된다. 나는 이 글에서 그들이 비판하는 계약론을 롤즈의 것을 중심으로 개괄하고 그에 대한 누스바움의 비판과 대안, 키테이의 비판과 대안 각각을 논할 것이다. 그러고 나서 그들이 비판하는 롤즈의 계약론의 주요 개념에 대한 오해를 해소하고, 더 나아가 몇몇 개념에 대한 재해석과 확장을 제안함으로써 롤즈적 계약론이 고령화, 복지 사회에서도 확장된 버전으로 유지되어야 한다고 주장할 것이다. 이를 위해 나는 롤즈의 “두 도덕적 능력”을 중심으로 취약한 존재들을 구분하고 각 경우에 알맞은 도덕적 지위를 논의함으로써, 우려와 달리 롤즈적 계약론이 취약자의 정의 문제를 해결할 수 있음을 보일 것이다. 내가 확장을 시도해 가면서까지 그의 계약론적 틀을 유지하고자 함은 다른 두 대안들이 지닌 윤리적 기반보다 롤즈적 계약론이 지닌 구성주의 윤리관이 지닌 매력 때문이다.
We shall be confronted with growing percentage of people vulnerable and dependent for their subsistence on others in an aging society and the Forth Industrial Revolution. Many have thought that contractarian or contractualist conceptions of justice address the issues of justice focusing independent and competent persons able to cooperating with and contributing to other members in their society. Can contractarian or contractualist conceptions of justice solve the problems of just distribution emerging in such new conditions? The purpose of this essay is to show a possibility of endorsing the contractualist conception of justice as a theory of justice for the dependent including many disabled people and care-givers. To do this, first, I summarize the essential elements of Rawls’s contractualist theory of justice, and second, I discuss Nussbaum’s and Kittay’s critique of Rawlsian theory and their alternatives, each of which is called capabilities approach and care-ethics, respectively. Their critiques are very insightful and fierce, but their alternatives also seem to have some limits. Thus, by reinterpreting and extending some ideas of Rawlsian theory, and by dividing the citizen into two cases according to whether they possess two moral powers and by addressing two cases separately, I argue that his contractualist conception of justice can remain still convincing in the future society with growing dependent persons.]
