국문 초록[abstracts]
미성년자가 자녀를 출산하고 양육하게 되는 경우 여러 가지 어려운 상황에 처하게 되는 것은 자명한 일이다. 이러한 점에서 미성년자를 위한 경제적, 사회적, 법제도적 조력이 반드시 필요하다. 이에 본 논문은 민법에서 미성년 미혼모가 자녀를 양육함에 있어서 어떠한 제도적 개선이 필요한가에 대하여 살펴보았다. 우선 민법은 미성년자라도 혼인을 하는 경우 성년으로 의제하고 있다. 이에 미성년 미혼모의 경우에도 자녀를 양육하는 경우 독자적인 법률행위를 할 수 있도록 성년으로 의제하는 것이 필요하다는 논의가 제기되고 있다. 본문에서는 성년의제 제도를 도입하는 경우 여러 가지 문제가 발생할 수 있고, 이것은 궁극적으로 미성년 미혼모를 보호하고자 하는 목적에도 부합하지 않는다는 점에서 ‘성년의제제도’를 도입하는 것이 미성년 미혼모가 처한 문제를 근본적으로 해결할 수 없다는 점을 서술하였다. 또한 성년제도의 도입과 관련하여 프랑스와 독일의 경우를 소개하였다. 프랑스의 ‘친권으로부터의 해제’와 독일의 기존의 성년선고제도와 성년의제가 제도화되지 못하였던 과정을 검토하였으며, 이러한 두 입법례가 우리에게 주는 시사점을 검토하였다. 또한 민법은 미성년 미혼모의 자에 대한 친권을 미성년자의 부모가 행사할 수 있도록 규정하고 있는데(민법 제910조), 이 규정은 미성년자가 부모와 함께 생활하지 않고 오랫동안 관계가 단절된 상태에서 오히려 미혼모가 자녀를 양육하는데 실질적인 도움이 되지 못할 뿐만 아니라 장애요소로 작용할 수 있다는 점에서 이에 대한 문제점을 지적하였다. 미성년자의 출산이 일반적이지 않다는 것을 감안한다면 전적으로 부모에게 모든 책임을 지도록 하는 것보다는 국가 또한 적극적으로 관여할 의무가 있다. 그러므로 실질적으로 미성년자의 양육을 도울 수 있도록 국가가 후견적 역할을 담당하여야 한다. 이런 의미에서 미성년 미혼모와 부모가 그 자에 대한 친권을 대행할 것을 합의하고 법원에 이를 신청한 경우 조부모가 친권대행을 할 수 있도록 하고 그렇지 않은 경우에는 법원이 후견인을 선임하는 것이 미성년 미혼모/부와 그 자를 위하여 바람직하다고 보았다. 미성년 미혼모/부가 부모와 합의하였다는 것은 다른 관점에서는 미성년부모의 의사가 존중되었다는 점에서도 이에 대한 의미는 크다. 이는 미성년 미혼모/부의 의사존중과 함께 미성년 미혼모의 자의 양육에 대한 현실 상황을 고려한 것으로 실질적으로 그들의 자를 양육하는데 있어서 도움을 줄 수 있는 자를 정할 수 있다는 점에서 필요하다고 보며, 그러한 합의가 이루어지지 않을 경우 국가가 후견인을 정하여 자의 양육에 실질적인 역할을 담당할 수 있도록 하는 것은 국가가 자녀양육에 있어서 후견적 역할을 할 수 있다는 점에서 바람직하다고 보았다.
다국어 초록[Multilingual Abstract]
It is self-evident that if a minor gives birth to a child and cares for his or her children, they will face many difficult situations. In this respect, social and legal institutional support for minors is essential. In this paper, I examined the institutional improvement in the civil law for minor child mothers. First of all, if you are married to a minor, you are aged. In the case of unmarried mothers of minor age, it is argued that it is necessary to refer to the mature age so that children can be allowed to perform their own legal acts. However, as we have seen in the text, the grounds for accepting the legal act unconditionally are insignificant because the minors are gathered. In addition, I can not necessarily protect minors from the fact that I am able to harm the safety of transactions due to the age limit, and most importantly, the responsibility is added to the minor. In addition, the age of marriage and marriage age are becoming the same today, and the present age of marriage (age 19 years) and marriage age (18 years old) is only one year in our country. I do not think the meaning is too big. On the other hand, we examined foreign legislative cases and the system of “release from custody” in the French Civil Act is a system that allows minors to be released from their parental rights in accordance with the judgment of the family court if the minor and the parent agree. This is not only emphasized on 'marriage' but also on the fact that when a certain age is reached, minors can be freed from their parental rights, so that they can be freed from their parental rights even in the case of non - marriages. However, it is not realistic for us to introduce the “custody system” of France. In addition, I examined the current problems of the current Civil Code and how to improve them on how to protect the rights of underprivileged mothers / minors and their children. First of all, the regulation to allow minors’ parental rights to minors to be exercised (Article 910 of the Civil Act) needs to be improved. Considering that the birth of minors is not common, minors should be more actively involved in bringing up unmarried mothers / minors of minor children rather than having them bear all the burden. Therefore, a grandparent may act as a parental guardian if an underage unmarried mother agrees that an underage unmarried mother and her parents will act in custody of the child, but if not, the court must appoint a guardian. It takes into account the reality of the care of underage unwed mothers / minors and the care of underage unwed mothers. It is an urgent matter to help those who can actually help them. In this extraordinary situation of the birth of underage unwed mothers, the state is more responsible for providing economic, social and legal support for child rearing.
