권리 개념을 중심으로 본 북한의 인권 문제

Concerns over the human rights situation in North Korea are growing. In order to diagnose and evaluate North Korea's human rights problems, it is necessary to start with an understanding of the general rights encompassing human rights. From this point of view, I briefly reviewed the meaning and formation conditions of rights, which is the upper concept of human rights, and then summarized the necessary elements to approve the rights issue by rights holders, rights contents, and rights guarantee methods. Then I discussed the characteristics of human rights as legal and moral aspects and then emphasized the intention of human rights as a moral right by addressing the limits of human rights as legal rights. Based on the comprehensive understanding of the concept of human rights, I examined the characteristics and contents of the North Korean style human rights asserted by North Korea, and to show that the position of North Korea cannot function as a sufficient reaction against the criticism of the North Korean human rights issues.
국문 초록[abstracts]
북한의 인권 문제에 대한 국내외를 비롯한 국제사회의 우려가 점증하고 있다. 북한의 인권 문제를 평가하기 위해서는 인권을 포괄하고 있는 권리 일반에 대한 이해로부터 출발할 필요가 있다. 이러한 관점에서 연구자는 권리일반의 의미와 형성 조건을 간략히 검토한 후 권리문제에 접근하기 위해 필요한 요소를 권리 주체, 권리 내용, 그리고 권리 보장방법 등으로 정리하였다. 이어서 연구자는 인권의 법적 권리로서의 특성과 도덕적 권리로서의 특성을 구분하여 논의한 후 법적 권리로서 인권의 한계를 언급하여 도덕적 권리로서 인권이 지닌 지향성을 강조하였다. 이러한 인권 개념의 종합적 이해를 바탕으로 하여, 최종적으로 북한이 주장하고 있는 우리식 인권관의 특징과 내용을 살펴보고, 북한의 입장이 북한 인권 문제의 비판에 대한 충분한 반론으로 기능할 수 있을지 여부를 검토하고자 하였다.
