초록[abstracts]
[환경오염, 산업재해, 약해(藥害), 유해물질, 의료사고 등 결과 발생의 메커니즘(mechanism)이 확실하지 않은 사안에서는 법의 영역에서 문제되는 인과관계 중 사실적 인과관계의 인정 여부를 판단함에 있어서 역학적 인과관계가 종종 이용된다. 이러한 상황은 최근 우리나라에서도 대법원 판례를 통하여 나타나고 있지만, 이에 대해서 학자들은 대법원이 아직도 사실적 인과관계를 인정하는 과정에서 역학적 인과관계가 가지는 의의와 한계를 제대로 파악하지 못하고 있는 점을 지적하고 있다. 필자는 그 원인 중 하나로 법의 영역에서 문제되는 인과관계를 인정함에 있어서 역학적 인과관계가 구체적으로 어떻게 이용될 수 있는지에 대해서 우리나라에서 많은 연구가 축적되어 있지 못한 점에 있다고 생각한다. 그리하여 본고에서는 우리나라보다 훨씬 많은 연구가 축적된 유럽과 미국의 논의에 주목하게 되었고, 그 중에서도 그간의 연구를 집대성한 것으로 평가되는 미국의 “과학적 증거에 관한 참조 매뉴얼”(Reference Manual on Scientific Evidence)을 기본 소재로 삼아서 미국의 논의를 살펴보았다. 이를 통하여 미력하나마 역학적 인과관계와 관련된 연구의 축적뿐만 아니라 실무에서의 원활한 활용에도 조금이나마 기여하기 위한 것을 본고의 목적으로 삼았다. 본고가 연구의 중심 소재로 삼은 미국의 “과학적 증거에 관한 참조 매뉴얼”에는 역학적 인과관계의 일반론과 관련하여 그동안 축적된 논의들이 체계적으로 정리되어 있을 뿐만 아니라 법의 영역에서 문제되는 인과관계의 증명 및 역학적 인과관계와의 관계와 관련하여 증거의 허용성과 증거의 충분성을 판단함에 있어서 역학의 역할을 재조명하고 있다. 이에 대한 제반 내용들은 향후 우리나라의 실무 운용에 있어서 중요한 참고자료 내지 시사점을 제공할 것으로 생각한다.
In the issue, the mechanism of eventuation of which is not clear like environmental contamination, industrial disaster, damage from chemicals, harmful substance, medical accidents, etc., Epidemiological Causations are often used in judging whether factual causality is admitted among the causal relationships in the field of law. This situation has recently appeared in the Supreme Court precedents in Korea, but scholars point out that the Supreme Court is still unable to grasp the meaning and limitations of the Epidemiological Causations in the process of admitting factual causality. I think the cause can be attributed to the fact that there are not many studies accumulated in our country about how the Epidemiological Causations can be used specifically in acknowledging the problematic causal relationship in the field of law. Thus, in this paper, attention has been paid to discussions in Europe and the United States where much more researches have been accumulated than our country, among them, on the "Reference Manual on Scientific Evidence" of the United States which is evaluated as a compiled research, was focused the review. Through this, this paper aimed to make any better contribution not only to the accumulation of research related to Epidemiological Causation but also to the smooth utilization in practice. In the US "Reference Manual on Scientific Evidence", which is the main subject of this study, not only is the discussions accumulated so far organized systematically in relation to the general theory of Epidemiological Causations, but the role of mechanics in judging the allowability of evidence and the adequacy of evidence in relation to the relationship between the proof of causal relationship and the Epidemiological Causation is being focused again. I think that all the contents of this will provide important reference material and implications for the practical operation of our country in the future.]
