초록[abstracts]
[임상현장에서 의료인은 환자를 자율적 인격체로 대하여 자신의 질병상태나 가능한 치료대안들, 그 예상 징후 등에 대하여 충분히 설명을 해야 할 윤리적 의무를 지니며, 환자는 이러한 정보에 대해 충분히 알고 동의여부를 자율적으로 결정한 권리를 지닌다. 그러나 설명 동의의 바람직한 윤리적 실천을 위해서는 자율적 동의가 실행될 수 있는 의사소통 구조와 동시에 취약한 상황에 처한 환자나 가족에 대한 돌봄의 과정이 선행되어야 한다. 왜냐하면 의료현장에서 상호이해와 합의가 일어날 수 있는 의사소통과 이들에 대한 돌봄의 과정이 없이는 진정한 의미에서 환자의 인격을 존중하는 설명 동의의 윤리적 실천이 어렵기 때문이다. 여성주의윤리는 설명 동의의 실천현장에서 자유로운 의사소통에 의한 동의를 방해하는 관료적 제도와 의료부권주의에 따른 의료관행, 그리고 가부장적 가족문화에 대한 비판적 시각을 제공하다고 여겨진다. 특히 여성주의 실천적 담론은 전문 의료인과 환자나 가족 사이에서 일어나는 의사소통과정에서 환자 중심의 참여를 촉진시킨다. 여성적 돌봄의 윤리는 인격의 존엄성이 위협받는 취약한 상황에 처한 환자를 상호의존적인 존재로서 이해하여 그들의 관심과 요구를 수용하여 책임을 지는 돌봄의 윤리적 시각을 제공해 줄 수 있다고 여겨진다.
Informed consent is widely seen as fundamental to clinical ethics. Informed consent ensures that patient can decide autonomously whether to permit or refuse medical treatment that affect them. From the clinical aspect of consent in health care, healthcare professionals inform patients of the risk, benefits, and alternatives of all proposed treatments and then allow the patient to choose among acceptable therapeutic alternatives. But ethically appropriate informed consent has not been achieved in the clinical practice. For the reason, successfully informed consent must involve a truly shared decision making and a dialogue throughout the course of the patient's relationship with health care professionals, as well as caring for the vulnerable patient. The personal dignity of patient is then respected and protected only by ensuring that they give truly informed consent. Feminist ethics approach can provide the critical aspect of the clinical practice of informed consent from the aspect of the communicative ethics, namely a feminist practical discourse and care ethics. Feminist ethics points out the critical aspect of the bureaucratic medical institution and authoritarian attitudes of physicians and medical paternalism and patriarchal family culture which interrupt the achievement of the ethical informed consent in clinical practice. Also, patient-centered feminist practical discourse aims to facilitate him participation in the communicative process between the healthcare professionals and patient and family members. And feminine ethics of care provides the ethical aspect for the responsibility and advocacy for vulnerable patient by offering support, trust, promotion of autonomy, and preserving the personal dignity.]
