국문 초록[abstracts]

종교적 신념을 이유로 필수적이고 통상적인 치료 행위를 거부하는 경우, 그리고 그 결과로 죽음이 예상되어 있는 상황에서 환자의 자율성 존중 원칙은 어디까지 존중받을 수 있는지에 대해서 많은 논란이 있어 왔다. 수혈을 하지 못하여 결국 죽음에 이르게 되는 상황은 단순하게 환자의 자율성을 존중하는 것이 시대적인 흐름이기 때문에 이 환자의 결정대로 의료진은 선행의 원칙을 버리고서 무력하게 따라가게 하는 것이 아니다. 이는 한 인간을 정의하는 데 있어서 그가 갖고 있는 종교적 신념과 가치관이 얼마나 중요한지를 생존에 앞서서 위치 시킨다는 의미이며 종교적 자유와 신념을 보장해 주는 것은 인간 존엄성과 가치를 지키기 위한 행동임을 선포하는 것이다. 선행의 원칙보다 환자의 자율성 존중 원칙을 우선시하는 것에는 종교적 자유와 신념과 같은 인간 존엄성과 가치를 더 존중하는 것이라는 분명하고 명확한 근거가 있어야만 하기 때문이다. 따라서 의료 현장에서 선행의 원칙 적용은 환자가 겪고 있는 질병을 낫게 하는 것에만, 그래서 생존하게 하는 것에만 관심을 두는 것이 아니라, 환자를 온전한 한 인간으로 바라보고 인간으로서 이 세상을 살아가는 데 있어서 근본적이고 본질적인 이유를 제시해주는 방향으로 해석되어야 할 것이며, 이는 단순하게 자율성 존중 원칙이 적용된 것이 아니라 광의의 선행 원칙이 적용된 사례라고 부를 수 있을 것이다. 의학이 존재하는 이유는 환자의 고통에 응답하여 돕고자 하는 의무를 실천하는 선행에 있다는 사실은 어느 상황에서도 변하지 않는다.

다국어 초록[Multilingual Abstract]

Controversy has abounded regarding respect for patients’ autonomy when death is expected, specifically as it relates to their refusal of essential and standard treatments on the grounds of religious beliefs. If a patient refuses a blood transfusion and subsequently dies, this does not mean that the medical staff have abandoned the principle of beneficence; rather, they have respected the autonomy of the patient and prioritized his/her religious beliefs and values. The guarantee of religious freedom and beliefs preserves human dignity and value. Therefore, there must be clear grounds for prioritizing respect for patients’ autonomy over beneficence. Beneficence in the medical field is not merely interested in treating disease and survival; it should be interpreted as viewing the patient as a human being who has convictions and reasons for leading a certain life. This is a broadened application of beneficence rather than merely respect for autonomy. The existence and purpose of medicine lie in doing good and responding to the suffering of the patient, which does not change under any circumstances.
