국문 초록[abstracts]

본고에서 검토하는 주제는 인공지능과 윤리와 법이다. 본고는 실정법학적 관점에서 인공지능과 관련된 모든 문제의 대강을 고찰하려는 것으로 인공지능에 관한 공학적 기술과 윤리학이나 철학 자체를 논하는 것은 아니다. 오늘 우리가 가지고 있는 책임의 개념은 근대 이후의 ‘자율적인 개인’이라는 개념과 밀접하게 결합되어 있다. 그러나 현재처럼 기계화되고 자동화된 물결은 개인의 의사결정에도 큰 영향을 미치게 되며 그 안에는 단순한 취향의 문제를 드러낼 뿐만 아니라 도덕적인 의사결정도 포함하고 있다. 그러므로 기술의 도덕화(moral machines) 등은 테크놀로지에 도덕적 가치를 포함시키는 것과 인공지능에 명시적인 도덕적 추론이나 도덕적 행위의 능력을 갖게 하는 것을 제창하는 시도이다. 이런 시도는 책임에 대한 우리의 생각과 실천의 재검토와 병행해야 한다. 왜냐하면 자율성을 줄여서 개인에게 무거운 책임을 돌려보내는 것은 도덕적으로 문제가 있기 때문이다. 본고에서는 인공지능의 윤리적 문제에 대해서 정리하였다. 윤리적 문제에 대해서 문제 삼는 것은 가치이다. 그러나 그것은 경제적 번영이나 효율 등과 같이 경제학이나 공학이 다루는 가치에 한정되지 않는 윤리학이 중심적으로 다루는 것으로서 결코 무시할 수 없는 보편성을 가진 가치이며 전형적인 것은 행복이나 쾌락과 괴로움이 아닌 형평성, 정의, 도덕, 진정성, 존엄, 자율성, 권리, 평등, 공동체, 전통 등이다. 그래서 인공지능의 윤리적 문제와 이런 가치들이 인공지능에 의해서 침해될 위험성에 관련되어 있으므로 본고에서 논의한 윤리원칙은 이러한 가치에 관련되어 있다. 하지만 논점을 일반화하여 요약하면 인공지능의 윤리적 과제는 ‘인류 전체의 번영과 행복을 촉진하고 희생을 최대한 줄이는 것이다. 그러나 이처럼 일반화하면 모든 과학기술에 대해서 범용적인 것과 다르게 인공지능에서 특수한 논점은 존재할까라는 의문이 든다. 인공지능의 네트워크화에 특수한 성질, 그것에 특유의 윤리적 문제는 무엇인가? 인공지능이란 무엇인가를 논할 때 간단하게 그것은 ‘쉴 새 없이 자동화하는 진보’라고 주장할 수 있다. 산업혁명은 단순한 물리적 노동을 자동화한 것이지만 컴퓨터 혁명은 단순한 지적 노동을 자동화한 것이라 할 수 있다. 현재의 인공지능혁명, 로봇혁명, IoT혁명에서는 더욱 더 복잡한 물리적 노동, 지적 노동을 자동화하고 있다. 그러나 이 새로운 기술혁명이 의미하는 것은 단지 수행할 업무의 복잡화나 고도화뿐만은 분명 아니다. 괴테는 젊은 베르테르의 슬픔에서 ‘나의 지식 따위는 누구나 가질 수 있다. 그러나 내 마음 이것만은 나밖에 갖지 못하는 것이다.’ 라고 고백하였지만 이러한 개성의 핵을 이루는 마음이라는 것이 기계라는 외부의 개입자가 갖는 편견에 속절없이 놀아난 것 자체가 근대 이후의 사회가 중요시한 가치에 큰 영향을 준다는 것은 다시 강조되어야 할 것이다.

다국어 초록[Multilingual Abstract]

The topics discussed in this paper are artificial intelligence, ethics and law. This paper does not discuss the engineering technology, ethics, and philosophy of artificial intelligence in order to examine the roughly all the problems related to artificial intelligence from the viewpoint of the law. The concept of responsibility we have today is tightly coupled with the concept of an ‘autonomous individual’ after the modern age. However, as it is now, mechanized and automated waves have a profound effect on individual decision making, including not only a matter of taste but also moral decision-making. Therefore, moral machines are an attempt to include moral values in technology and to make artificial intelligence have the ability of explicit moral reasoning or moral action. Such attempts should be accompanied by a review of our thinking and practice of accountability. Because it is morally problematic to reduce the autonomy and return the heavy responsibility for the individual. This paper summarizes the ethical problems of artificial intelligence. It is value to question of ethical issues. However, it is a value with universality that can not be ignored, as it is centered on ethics, which is not limited to the value of economics or engineering, such as economic prosperity or efficiency. Typical values are fairness, justice, morality, dignity, autonomy, rights, equality, community, and tradition. Therefore, the ethical issues of artificial intelligence and the ethical principles discussed in this paper are related to these values, as these values are related to the risk of being infringed by artificial intelligence. However, in generalizing and summarizing the issues, the ethical task of artificial intelligence is to promote the prosperity and happiness of humanity as a whole and to reduce the sacrifice as much as possible. However, this generalization raises the question of whether there are specific issues in artificial intelligence as with all science and technology. What is the special nature of artificial intelligence networking, and its ethical issues? When discussing what artificial intelligence is, it can be argued simply that it is ‘a progressive automation progress.’ The Industrial Revolution automates mere physical labor, but the computer revolution is an automation of mere intellectual labor. The current artificial intelligence revolution, the robot revolution, and the IoT revolution automate more complex physical and intellectual labor. But what this new technology revolution means is not just the complexity or sophistication of the work to be done. Goethe, in the “The Sorrows of Young Werther (German: Die Leiden des jungen Werthers),” said, “Knowledge with anyone for the likes of me. However, my mind is the only one that I can not have.” However, it should be emphasized that the fact that the mind that forms the nucleus of personality plays on the prejudice of the external interventionist of the machine itself has a great influence on the value which the post-modern society values.
