초록[abstracts] [생명과학기술의 발전은 인간의 건강과 삶의 질을 향상시키고 수명 연장에 기여해 왔다. 전 세계적으로 생명과학기술은 발전을 거듭하고 있고 동시에 인간과 자연에 대한 돌이킬 수 없는 위험의 가능성이 예견되면서 인간의 존엄성 등과 관련된 헌법적 문제가 제기되었다. 이처럼 생명과학기술의 발전은 동전의 양면처럼 긍정적인 측면과 부정적인 측면을 동시에 지니고 있다. 배아줄기세포 연구를 비롯한 일련의 생명공학에 대한 규범적・윤리적 기준을 마련해야 한다는 의견이 증가하면서 세계 각국은 이에 대한 기준을 마련하게 되었다. 이에 배아줄기세포 연구에 대한 국제사회의 경쟁이 더욱 치열해질 것이라는 전망이 나오고 있으며, 우리나라의 국가경쟁력을 위해서 하루빨리 배아줄기세포연구에 대한 지원책을 강화해야 한다는 목소리에 힘을 얻고 있다. 이 논문은 생명윤리법상 배아줄기세포 연구를 둘러싼 현황과 문제점을 점검하고 분석하는 것 이외에도 이에 대한 방안을 제시하였다. 황우석 사태 이후, 국내배아줄기세포 연구의 정책 변화를 살펴보고자 하는 것은 그 이면에 존재하고 있는 생명윤리의 진보를 위해서 생명공학 분야는 계속 국가의 지원을 받으면서 정책적으로나 법제도적으로 연구될 필요가 있기 때문이다.
The development of biotechnology has improved the quality of life and health of humans, and also contributed to the life extension. In the whole world, the biotechnology is continuously developing. As the possibility of irreversible danger to humans and nature is predicted, the constitutional issues related to humans" dignity have been raised. Just like the heads and tails, the development of biotechnology has both positive and negative aspects at the same time. With the increased opinions about establishing the normative/ethical standards of a series of biotechnology including the embryonic stem cell researches, each country in the world has established the relevant standards. With the prospect of more intense competition for the embryonic stem cell researches in the international society, it would be urgently needed to strengthen the measures for supporting the embryonic stem cell researches for the national competitiveness of Korea. On top of reviewing and analyzing many issues related to the embryonic stem cell researches under the bioethics law, this paper also suggested the alternative. This study aimed to examine the current status of embryonic cloning researches by understanding the changes in domestic policies of stem cell researches since the Hwang, Woo-Suk scandal because the biotechnology area should be continuously researched institutionally and legally under the national support for the advancement of bioethics.]
