초록[abstracts]
[이 글은 일견 극단적 보수주의로 보이는 칸트의 성윤리가 지닌 구조와 다양한 요소들을 분석하고 평가하여 더욱 그럴 듯한 ‘칸트적 성윤리’를 재구성해 보는 것을 목표로 한다. 칸트의 성윤리는 섹스 본성론의 부분과 윤리적 장치의 부분으로 크게 나뉜다. 전자에는 (1) 목적론이 반영된 섹스 본성론과 (2) 인격을 수단화하는 활동으로서의 섹스 본성론이 포함되고, 후자에는 (3) 인간을 수단으로만 이용하는 것을 금지하는 정언명령과 (4) 서로 평등하게 이익이 되는 관계로서의 호혜성이 포함된다. 나는 (1)은 칸트 자신의 철학적 입장과 비정합적임을 보이고 (2)를 이루는 요소들이 모두 논박됨을 보여 도덕적 가치가 이미 탑재된 섹스 본성론이 중립적인 섹스 개념으로 바뀌어야 한다고 주장한다. 만약 이런 시도가 성공한다면, 칸트의 성윤리에서는 (3)이 가장 중요한 요소가 된다. 나는 (3) 즉 정언명령을 성적 활동의 문제에 있어 어떻게 해석하여 적용하는 것이 좋을지에 대해 노직, 맵스, 오닐, 누스바움이 각각 대표하는 재해석의 스펙트럼을 비판적으로 검토하여, ‘칸트적 성윤리’의 모습을 그려볼 것이다. 이는 좀 더 관계와 맥락에 민감한 버전의 자유주의적 성윤리의 모습으로 보인다. 이 입장에 따르면 (4)에 해당하는 섹스의 도덕적 구제책으로서의 결혼 장치는 불필요하다.
The aim of this essay is to reconstruct Kant’s sexual ethics into a more plausible version of ‘Kantian sexual ethics’ by analyzing and appreciating the structure and various elements of Kant’s sexual ethics. I show that Kant’s sexual ethics is divided into ideas of sex and the frames of ethical judgments. The former is analyzed into (1) the teleological conception of sex, and (2) the conception of sex as activities exploiting persons. The latter is analyzed into (3) the categorical imperative prohibiting the exploitation of persons and (4) reciprocal marriage as an equal legal relation. I argue that, first, (1) is inconsistent with Kant’s own philosophical project, and second, all the elements in (2) are refuted, and then argue that his idea of sex lading moral values should be changed into value-neutral ideas of sex. If this is the case, (3) is supposed to become the most important element in Kant’s sexual ethics. I try to give the outline of ‘Kantian ethics’ by reviewing various interpretations in regard to how to apply the categorical imperative to the problems of sexual activities. The outcome might look like liberal sexual ethics, according to which (4) is unnecessary.]
